1. Acceptance of These Terms
These Terms of Service (the "Terms") form a binding agreement between you and YourGrails LLC, a Wyoming limited liability company ("YourGrails," "we," "us," or "our"). The Terms govern your access to and use of the website located at yourgrails.com, any related subdomains, mobile applications, and all features and services offered through them (together, the "Service").
By creating an account, connecting a wallet, purchasing a pack, entering a pack battle, listing a card for sale, buying a card on the Marketplace, redeeming a card, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You also agree to the following documents, which are incorporated into these Terms by reference.
The YourGrails Privacy Policy.
The YourGrails NFT Terms and Asset Management Services Agreement (the "NFT Terms"), which apply to every Card Token you acquire through the Service.
Any additional terms posted on the Service that apply to specific features.
If these Terms conflict with the NFT Terms with respect to a Card Token, the NFT Terms control as to that conflict only.
If you are using the Service on behalf of an entity, you represent that you have the authority to bind that entity. In that case, "you" means both you personally and the entity.
We may update these Terms at any time. When we do, we will post the updated version on the Service and update the Effective Date above. Material changes will also be communicated by email or in-app notice. Continued use of the Service after the update constitutes acceptance.
2. Eligibility
To use the Service, you must meet all of the following.
Be at least eighteen (18) years old, or the age of majority in your jurisdiction, whichever is higher. Pack Battles require age twenty-one (21) under Section 7.
Have the legal capacity to enter into binding contracts.
Not be a resident of, or accessing the Service from, any jurisdiction in which use of the Service is prohibited by law.
Not be listed on any sanctions list maintained by the U.S. Office of Foreign Assets Control (OFAC), the United Nations Security Council, the European Union, or any other applicable sanctions authority.
Not be located in a country subject to U.S. embargo, including Cuba, Iran, North Korea, Syria, the Crimea region, and the so-called Donetsk and Luhansk People's Republics.
We may restrict access to the Service, in whole or in part, from any jurisdiction at any time. We may add or remove jurisdictional restrictions in our sole discretion based on legal, regulatory, or operational considerations.
We may require identity verification (KYC) at any time. We may suspend or terminate your account if you fail to complete verification or if we determine, in our reasonable discretion, that you do not meet eligibility requirements.
3. Accounts and Wallets
To use most features of the Service, you must create an account and connect a compatible self-custodial cryptocurrency wallet, or use a wallet provisioned through the Service.
You are responsible for the following.
The security of your wallet, including private keys, seed phrases, and recovery information.
All activity that occurs under your account or through your wallet.
Maintaining accurate and current account information.
We do not store your private keys or seed phrases. If you lose access to your wallet, we cannot recover it for you. Loss of your wallet may result in permanent loss of access to your cards and any digital assets associated with that wallet.
Notify us immediately at support@yourgrails.com if you suspect unauthorized access to your account or wallet.
4. The Service
YourGrails offers a digital pack opening platform built on the Avalanche blockchain. The Service includes the following features.
Pack Sales. Purchase digital packs that contain Card Tokens corresponding to physical, professionally graded trading cards held in secure third-party custody. The NFT Terms govern your rights and obligations with respect to each Card Token.
Pack Opening. Reveal the cards contained in your purchased packs.
Pack Battles. Compete head-to-head with another user. Both users open a pack of equal value and the user with the higher card value wins a bonus pack. Section 7 governs Pack Battles in full.
Buyback. Exercise a buyback option to receive ninety percent (90%) of the assessed value of any card you pull, paid in the form designated by YourGrails. Section 8 governs the buyback.
Marketplace. List Card Tokens for sale to other users, or purchase Card Tokens listed by other users. Section 9 governs Marketplace transactions.
Redemption. Request physical shipment of any card you own through the Service. Section 10 governs redemption.
The Service is not a securities exchange, broker, dealer, investment adviser, money services business, or bank. The Service does not offer investment products and does not provide investment, financial, tax, or legal advice.
5. Cards, Custody, and Ownership
Each digital pack contains one or more Card Tokens issued on the Avalanche blockchain. Each Card Token represents beneficial ownership of one specific physical trading card (the "Underlying Card") held by YourGrails or a third-party custodian on behalf of the holder of the Card Token. The detailed terms governing each Card Token are set forth in the NFT Terms.
The following apply to all Underlying Cards.
All Underlying Cards are graded by Professional Sports Authenticator (PSA), Certified Guaranty Company (CGC), or Beckett Grading Services (BGS).
Each Underlying Card is stored in a secure, climate-controlled facility and is insured during storage and shipment, subject to the insurance terms of our custodian.
The holder of a Card Token is the beneficial owner of the corresponding Underlying Card.
Transfer of a Card Token transfers beneficial ownership of the Underlying Card and, under the NFT Terms, assigns the related Asset Management Services Agreement to the new holder by way of novation.
YourGrails does not take title to, and is not the legal owner of, Underlying Cards held on behalf of users.
We do not guarantee the future market value of any card. Card grades are determined by independent third-party graders and YourGrails is not responsible for grading decisions or grade changes.
6. Pack Purchases and Odds
We offer packs in two tiers, with the price per pack and the odds of pulling each rarity tier published on the Service at the time of purchase. As of the Effective Date, the standard pack tiers are as follows.
Standard Pack. Fifty dollars ($50) per pack.
Premium Pack. One hundred dollars ($100) per pack.
Each pack contains one card pulled at random from the inventory available for that tier. The published odds at the Effective Date are seventy-five percent (75%) Common, twenty percent (20%) Uncommon, four percent (4%) Rare, and one percent (1%) Epic. These odds can fluctuate and will be updated to reflect on the respective pack webpages.
The following apply to all pack purchases.
Random. Card distribution is determined by a verifiable random function or other randomness source disclosed on the Service.
Final. All pack purchases are final once the pack is opened.
No refunds. We do not offer refunds on packs that have been opened, except where required by applicable law.
No guarantees. We do not guarantee that any specific card will be available in any pack at any time.
Inventory. Pack contents are drawn from a published inventory pool. We may add to, remove from, or adjust the inventory pool at our discretion. Any change is communicated through the Service.
7. Pack Battles
Pack Battles are a head-to-head feature in which two users each open a pack of equal value and the user with the higher total card value, as determined by the valuation method disclosed on the Service, wins a bonus pack of equal value.
By entering a Pack Battle, you acknowledge and agree to each of the following.
Random outcome. The outcome of a Pack Battle is determined by the random card distribution within each pack.
You may lose. You may receive a card of lesser value than your opponent and not win the bonus pack. The card you pull from your initial pack remains yours regardless of the Pack Battle outcome.
No assurance of profit. Participation in Pack Battles is not a path to guaranteed return and should not be treated as an investment activity.
Adults only. Pack Battles are available only to users who are at least twenty-one (21) years old.
Jurisdiction is your responsibility. You are responsible for ensuring that your participation in Pack Battles is lawful in the jurisdiction where you are located. We may restrict access to Pack Battles, in whole or in part, from any jurisdiction at any time without notice based on legal, regulatory, or operational considerations.
No misrepresentation. You agree not to misrepresent your age, location, identity, or eligibility to access Pack Battles. Any such misrepresentation is a material breach of these Terms.
Pack Battle Transaction Flow
A single Pack Battle may involve up to six (6) on-chain transactions, including pack openings for both users, buyback exercise by either or both users, opening of the bonus pack by the winner, and buyback exercise on the bonus pack. Standard network fees apply to each transaction.
Not Gambling
YourGrails does not consider Pack Battles to be a gambling product. The activity centers on the purchase and acquisition of valuable physical trading cards, and the card you pull from your initial pack is yours regardless of the Pack Battle outcome. You acknowledge and agree that the legal characterization of Pack Battles is unsettled under the law of many jurisdictions and that you are responsible for ensuring that your participation is lawful where you are located.
8. The Buyback Option
For any card you pull from a pack or otherwise own as a Card Token on the Service, you may exercise a buyback option to receive ninety percent (90%) of the then-current assessed value of that card, paid in the medium designated by YourGrails at the time of buyback (which may include U.S. dollar stablecoin, fiat U.S. dollars, or another digital asset).
The following apply to all buybacks.
Assessed value. Assessed value is determined by YourGrails using market data sources disclosed on the Service. We may revise our valuation methodology from time to time.
Pool funded. Buyback obligations are funded through a dedicated reserve pool replenished by pack sale revenue. We maintain operational guardrails on this pool, including manual review for large buybacks.
Time of exercise. The buyback option may be exercised within the time window disclosed on the Service for the relevant card.
One time. Once you exercise the buyback option on a card and the buyback is settled, the Card Token is burned and the Underlying Card returns to the YourGrails inventory pool. The transaction is final and cannot be reversed.
Large buybacks. Buybacks above a threshold disclosed on the Service may be subject to manual review and processing delays of up to seventy-two (72) hours.
Suspension. We may temporarily suspend the buyback function during periods of extreme market disruption, technical maintenance, or to protect the integrity of the buyback reserve. Suspension does not extinguish your right to exercise the buyback when the function resumes.
The buyback option is a contractual commitment of YourGrails. It is not a security, deposit, or investment product. Funds in the buyback reserve are not FDIC insured.
9. Marketplace
The Marketplace is a feature of the Service that lets users list Card Tokens for sale to other users and purchase Card Tokens listed by other users. YourGrails operates the Marketplace technology but, except where YourGrails is itself a listed seller, is not a party to transactions between users.
9.1 Seller Obligations
If you list a Card Token for sale on the Marketplace (acting as a "Seller"), you represent and warrant as follows.
Ownership. You are the rightful holder of the Card Token at the time of listing and have full authority to sell it.
No encumbrance. The Card Token is not subject to any lien, pledge, claim, or other encumbrance.
Accurate listing. All information you provide about the Card Token, including any description, photograph, or condition note, is accurate and not misleading.
Pricing authority. You set the listing price in your sole discretion, subject to any minimum or maximum prices we may impose for operational reasons.
No prohibited content. The listing does not violate Section 13 or any other provision of these Terms.
By listing a Card Token, you grant YourGrails a non-exclusive license to display the listing, including any images and description, on the Service for promotional and operational purposes.
9.2 Buyer Obligations
If you purchase a Card Token from another user on the Marketplace (acting as a "Buyer"), you acknowledge and agree as follows.
As-listed. You are purchasing the Card Token as listed and as it exists at the time of purchase. The grade and condition of the Underlying Card are as established by the third-party grader on its current label.
Final sale. Marketplace purchases are final once the on-chain transaction settles. YourGrails does not facilitate returns or refunds for Marketplace purchases.
Novation. Upon purchase, you assume the rights and obligations of the Seller under the NFT Terms with respect to that Card Token by way of novation, as described in the NFT Terms.
9.3 Settlement
Marketplace transactions settle on the Avalanche blockchain. Upon successful settlement, the Card Token is transferred to the Buyer's wallet and the purchase price (less any applicable fees) is delivered to the Seller in the form designated on the Service.
We may hold settlement funds for a reasonable period to confirm transaction finality, screen for fraud, or comply with applicable law.
9.4 Fees
YourGrails may charge fees on Marketplace transactions, including listing fees, transaction fees, royalties, and withdrawal fees. Current fees are disclosed on the Service at the time of the relevant transaction. Fees may differ between Sellers, transaction types, and geographies.
Network fees on the Avalanche blockchain are paid by the party initiating the on-chain transaction.
9.5 Disputes Between Buyers and Sellers
YourGrails is not a party to Marketplace transactions between users. We do not adjudicate disputes between Buyers and Sellers regarding price, description, condition, or any other matter related to a Marketplace transaction. You agree to resolve any such dispute directly with the other party.
We may, in our discretion, provide support in resolving disputes. Any such support is provided as a courtesy and does not create any obligation on our part.
9.6 YourGrails as Seller
From time to time, YourGrails may itself list Card Tokens for sale on the Marketplace, including Card Tokens returned to inventory through the buyback option. When YourGrails is the Seller, these Terms govern the transaction and YourGrails is a direct party to the sale, subject to the same finality, settlement, and fee provisions that apply to other Sellers.
9.7 Listing Removal
We may remove any listing from the Marketplace at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, or operational necessity.
9.8 No Price Endorsement
Listing prices are set by Sellers. YourGrails does not endorse, recommend, or guarantee any listing price. You should conduct your own research before purchasing any Card Token.
9.9 Anti-Wash-Trading
You agree not to engage in wash trading, self-dealing, or any other artificial trading activity on the Marketplace. This includes trading between wallets you control, trading with parties acting in concert with you to inflate prices or volumes, or any other activity designed to create a misleading appearance of market activity. Violation may result in account termination and forfeiture of related transactions.
10. Redemption and Shipping
You may request physical shipment of any Underlying Card you own through the Service. This process is referred to as "Redemption." Upon Redemption, the corresponding Card Token is burned and the Underlying Card is shipped to the address you provide.
10.1 Eligibility for Redemption
To request Redemption, you must meet all of the following.
Hold the Card Token in your connected wallet at the time of the request.
Have completed identity verification (KYC) to our satisfaction if determined to be applicable.
Provide a valid shipping address in a destination to which we ship.
Pay all applicable redemption fees, shipping charges, insurance costs, and taxes or duties.
10.2 Redemption Process
Request. You initiate a Redemption request through the Service.
Confirmation. We confirm the request and provide an itemized cost breakdown for shipping, insurance, and fees.
Payment. You authorize payment of all applicable charges. We may require payment in the form designated on the Service.
Burn. Upon confirmation of payment, the Card Token is burned on the Avalanche blockchain. The burn is permanent and cannot be reversed.
Preparation. The Underlying Card is retrieved from the custodian, inspected, and packaged for shipment.
Shipment. The Underlying Card is shipped to the address you provided through a carrier we select. We provide tracking information when available.
10.3 Processing Time
Standard processing times from request to shipment are disclosed on the Service. Processing time does not include carrier transit time. Processing time may be longer during periods of high volume or for high-value cards subject to additional handling.
10.4 Fees and Charges
You are responsible for all fees and charges associated with Redemption, which may include the following.
Redemption fee. A YourGrails service fee for processing the Redemption, as disclosed on the Service.
Shipping. Standard or expedited shipping charges based on destination and weight.
Insurance. Insurance during transit, at coverage levels determined by us based on the assessed value of the card.
Customs and duties. All customs duties, import taxes, and other government charges. You are the importer of record for international shipments.
Reship fees. If a shipment is returned due to an incorrect address, refused delivery, or other reason within your control, reshipment is at your expense.
10.5 Shipping Destinations
We ship to destinations disclosed on the Service. We may decline to ship to any destination subject to U.S. export controls, sanctions, carrier restrictions, or where shipment is otherwise impracticable.
For international shipments, you are responsible for ensuring that import of the Underlying Card is permitted in the destination country.
10.6 Risk of Loss
Once a shipment is tendered to the carrier, risk of loss transfers to you, subject to any insurance coverage we provide. In the event of loss or damage during shipment, we will work with you and the carrier to file an insurance claim. Recovery is limited to the insured value.
10.7 Inspection upon Receipt
You must inspect the Underlying Card upon receipt and report any damage or discrepancy to us within seven (7) days of delivery. After this period, the Underlying Card is deemed accepted as delivered.
10.8 Returns
Redemption is final once the Card Token is burned. We do not accept returns of redeemed Underlying Cards except where required by law or where we, in our discretion, agree to a return for reasons of damage in transit or shipping error.
10.9 Unredeemed Cards
If a shipment is undeliverable and not claimed within a reasonable period disclosed on the Service, we may, after notice to you, take possession of the Underlying Card and credit your account with its assessed value, less applicable fees.
11. Fees
We charge fees for certain transactions, including pack purchases, Pack Battles, Marketplace transactions, buybacks (in the form of the ten percent (10%) spread between assessed value and the buyback amount), and Redemption. Current fees are disclosed on the Service at the time of the relevant transaction.
You are also responsible for blockchain network fees (sometimes called gas fees) associated with on-chain transactions. These fees are paid to the Avalanche network and not to YourGrails.
All fees are non-refundable except where required by applicable law.
12. No Token
YourGrails has not issued, and does not intend to issue, any token, coin, or other digital asset that represents an ownership interest in, profit share from, or claim against YourGrails or its assets. Card Tokens represent beneficial ownership of physical trading cards and are not securities. Anyone offering you a "YourGrails token," "YGR token," or similar instrument is engaged in fraud. Report any such offer to support@yourgrails.com immediately.
13. Prohibited Conduct
You agree not to do any of the following.
Use the Service in violation of any applicable law, regulation, sanctions program, or these Terms.
Use the Service to launder funds, finance terrorism, evade taxes, or for any other unlawful purpose.
Attempt to manipulate Pack Battle outcomes, Marketplace prices, card valuations, or any other element of the Service.
Engage in wash trading, self-dealing, or any other form of artificial trading activity on the Marketplace.
Use bots, scripts, scrapers, or other automated tools to access the Service without our prior written consent.
Attempt to bypass age verification, KYC requirements, or any other access control.
Reverse engineer, decompile, or disassemble any part of the Service, except as expressly permitted by applicable law.
Interfere with the operation of the Service, introduce malicious code, or attempt to gain unauthorized access to any part of the Service.
Impersonate any person or misrepresent your affiliation with any person or entity.
Use the Service to harass, threaten, defame, or harm any other person.
Resell, sublicense, or otherwise commercially exploit the Service except as expressly permitted under these Terms.
List or sell stolen, counterfeit, altered, or otherwise illegitimate Card Tokens or Underlying Cards on the Marketplace.
We may suspend or terminate your account, with or without notice, for any violation of this section.
14. Intellectual Property
YourGrails owns or licenses all intellectual property rights in the Service, including the website, software, branding, logos, designs, text, images, and other content (excluding user content and Underlying Card images licensed from third parties).
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.
Card Tokens may incorporate artwork or imagery licensed from third parties, including grading companies and sports licensors. The NFT Terms govern the intellectual property rights associated with each Card Token. Ownership of a Card Token does not grant you any rights in the Underlying Card's intellectual property beyond ownership of the physical card itself.
You may not use YourGrails trademarks, logos, or branding without our prior written consent.
15. User Content
You may submit content to the Service, including profile information, comments, listing descriptions, and other materials ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant YourGrails a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, display, modify, and distribute your User Content in connection with operating and promoting the Service.
You represent and warrant that you own or have the necessary rights to your User Content and that your User Content does not violate any law or any third party's rights.
We may remove any User Content at our discretion.
16. Blockchain Risks
You understand and accept the following risks associated with using a blockchain-based service.
Public ledger. All on-chain transactions are public and permanent. Transactions cannot be reversed.
Wallet loss. Loss of your wallet credentials means permanent loss of access to your tokens. We cannot recover them.
Network risk. The Avalanche network may experience outages, congestion, forks, or attacks. We do not control the Avalanche network.
Smart contract risk. Smart contracts may contain bugs or vulnerabilities. We audit our contracts but do not guarantee that they are free of defects.
Regulatory risk. Digital asset regulation is evolving. Future regulation may affect the availability of the Service or the value of Card Tokens.
Price volatility. The value of digital assets is volatile. The value of any digital asset received through buyback or Marketplace settlement may decline rapidly.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, YOURGRAILS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
WE DO NOT WARRANT THE ACCURACY OF ANY CARD VALUATION, ODDS DISPLAY, LISTING DESCRIPTION, OR THIRD-PARTY GRADE.
NOTHING ON THE SERVICE CONSTITUTES INVESTMENT, FINANCIAL, TAX, OR LEGAL ADVICE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOURGRAILS AND ITS OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100), OR (B) THE TOTAL AMOUNT YOU PAID TO YOURGRAILS IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND EVEN IF YOURGRAILS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
19. Indemnification
You agree to indemnify, defend, and hold harmless YourGrails and its officers, members, managers, employees, agents, and affiliates from and against any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) any User Content or listing you submit.
We may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.
20. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A LAWSUIT IN COURT.
Informal Resolution
Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at support@yourgrails.com. We will attempt to resolve the dispute within sixty (60) days of receipt of your notice.
Arbitration
If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms or the Service will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration will be conducted in Wyoming, or such other location as the parties may agree, by a single arbitrator. The arbitrator's decision will be final and binding.
Class Action Waiver
YOU AND YOURGRAILS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF A CLASS PROCEEDING.
Exceptions
Either party may seek injunctive or equitable relief in court for intellectual property infringement, misappropriation of trade secrets, or violation of these Terms.
Opt Out
You may opt out of this arbitration agreement by sending written notice to support@yourgrails.com within thirty (30) days of first agreeing to these Terms. Opt-out notices received after that period will not be effective.
21. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Subject to Section 20, any action that may be brought in court will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.
22. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms.
You may terminate your account at any time by contacting us at support@yourgrails.com and following the account closure process. Upon termination, you remain entitled to redeem or sell any Card Tokens you own at the time of termination, subject to compliance with applicable verification requirements.

23. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy, the NFT Terms, and any other documents incorporated by reference, are the entire agreement between you and YourGrails regarding the Service.
Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, war, terrorism, pandemic, government action, network outages, or smart contract exploits.
